The electronic shop of online commercial transaction of services and products (www.aishadiri.com) is created by the company under the name “ AISHA DIRI”, uses AISHA QUO & VENTUS as trademark, resides in Athens and is legally represented, the Tax Registration Number is 125695163 and answers to the Tax Office in Athens, uses an email address (info@aishadiri.com) and a telephone service line: +30 2130338569 and will be referred as “Aisha Diri” below. The present internet website has been created by the above company to offer instant notice to the consumers about its products, enabling them to make long distance online orders and also giving the ability of interactive communication between visitors, users, customers (below “users/customers”) and Aisha Diri through comments and preference externalisation in certain kinds, using the services of social media. With the general terms of the present contract the company wishes to declare in the most clear, definite and comprehensible way according to the principle of good faith and the restrictions of all legal transactions, the terms and conditions under which it operates, as stated on the Legislation 2251/1994 regarding “Consumer Protection” and specifically the restrictions about long distance commercial transactions.

2. Accepting the Terms of Use

Each user/customer to enter and use the services of the electronic shop is considered to agree and accept unconditionaly the below terms, which are completely contractual with the current European and Greek Law. The user’s/customer’s or third parties non compliance with the legislation leads to the abrogation of all responsibility on behalf of Aisha Diri regarding any eroded natural or legal persons. The user/customer recognizes the right of Aisha Diri to alter the restrictions on the present terms, as long as they do not refer to any legally binding obligations or affect accomplished facts.

The user/customer who visits Aisha Diri accepts to have read the present terms, agrees with them and is obliged to abide by them, in the context of the contract regarding their acceptance, as well as in the context of one’s general obligation to comply with the law. In the case a user/customer does not agree with these terms, he/she is obliged not to have any transactions with Aisha Diri.

Aisha Diri is commited to the quality, plenitude and accuracy of the information, which are stated on the website www.aishadiri.com, regarding the precise displayed details, as well as the services that the electronic store provides. The company, in the context of good faith, is not responsible or bound to any errors which come as a result of misrecording the electronic data in the shop.

4. Responsibility Limitation

Aisha Diri is not responsible towards the users/customers for any damages that may be caused during the execution or not of an order (except for the case of product withdrawal – return – replacement).

Aisha Diri provides the content (e.g. information, names, photos, images etc), the products and the services wich are displayed on the website “exactly as they are”.

Aisha Diri is not responsible under no conditions for any demands of legal or civil or/and penal nature, or any damage (positive, specified or deposited which indicatively and not restrictively, seperately and/or accumulatively consists in loss of profits, facts, financial award etc) by visitors/users/customers or third parties of the website due to a reason related to the function or not and/or the use of the website and/or inability in provided services and/or provided information and/or any non permitted interventions of thirds in products and/or information displayed on the website.

The entire content of Aisha Diri, including trademark, signs, images, graphics, photos, texts etc. constitute original intellectual creation of “AISHA DIRI” firm, and as such they are protected under the relevant restrictions of Greek Law, European Law and International Legislations. Any act of replication, transfer or use of the content for commercial purposes or public deception regarding the original provider of the website’s content is prohibited. Any act of reproduction, republication, uploading, report, dissemination or transmission or any other use of the content in any which way or means for commercial or any otherpurposes with the prior written consent of “AISHA DIRI” or any other beneficiary of the copyrights is permitted. Names, images, logotypes and trademarks, which represent Aisha Diri or third parties, as well as products or services, constitute exclusive signs of “AISHA DIRI” or third parties and as such they are protected under the relevant restrictions concerning trademarks. Their appearance on Aisha Diri website should not be considered as transmission or conveyance of use.

6. Personal Data and Electronic Transactions Security

We would like to inform you that in order to commence our between transactions some of your personal data are necessary. These personal data are asked in the context of the function of this electronic shop and  therefore we are bound to respect them. The present website consistents with the provisions of Law 2472/1997 regarding the “Protection of an individual from processing personal data” and Law 3471/2006 regarding the “Protection of personal data and privacy in electronic communications”.

Information that have been willingly provided by the visitors/users of the present website, are used by the shop in order to achieve direct communication, best service and order execution. The shop does not distribute not transfers to any other third person (natural or legal), who is not related to the Firm in any way the information of the visitors/users, with the exception of certain provisions of the legislation regarding the authorities.

The present website is designed in such a way, so that the provision of personal data of the visitors/users is only necessary when it comes to ordering products, signing in the website or communicate with the manager using electronic mail. 7. User/customer Recognition Codes

The codes that are used for the user/customer recognition are two: the Sign In Code (Username) and the Personal Secret Security Code (Password), which each time they are registered the user/customer is provided his/her personal data with maximum security. The password may be altered by the user/customer for safety reasons. The user/customer has exclusive access in the account using the above codes and is the only one responsible to keep them secret to any third persons. In the case of loss or leak, the user/customer should immediately notify Aisha Diri, or else Aisha Diri cannot be considered responsible for the use of the password by a non authorized person. Aisha Diri in no way reveals or publicizes personal data and information which users/customers confide to the website. Personal data which a user/customer distributes to Aisha Diri, when registering to the website are strictly used for transactions execution. All information are encrypted and kept safely.

The user/customer of this website is able to proceed to long distance online product orders, according to the Greek Civil Code and the terms and order procedure of the present website.

12. Order Procedure

During the purchase and execution of the order, the user/customer is directed step by step to the automatic system suggestions. The order will be filed. When the order is completed, the user/customer will be notified with an e-mail about verifying the order delivery. Aisha Diri also has the right to communicate with the user/customer by telephone to verify the order. Aisha Diri is obligated to restore a possible error during the execution of the order, in the event that Aisha Diri is responsible for it. Aisha Diri will send informative electronic mail to the user/customer, including the details on the progress of the order.

13. Product Prices

The labelled prices on the products include all legal taxes and the shop has the right to adjust the prices at will. The labelled prices do not include shipping fees. The total cost (including shipping fees) is confirmed while completing the order. These prices refer to the stock availability and the shop has the right to adjust the prices.

14. Payment Method

Aisha Diri uses the following payment methods:

- Collect on Delivery

The payment may be completed with a Retail Sale Receipt when the order is delivered to the user/customer by the courrier firm.

- Bank Account Deposit

The payment may be settled with the deposit of the total amount at a bank account. Aisha Diri will communicate with the user/customer when the order is ready and will inform him/her about the total cost as well as the bank account in which the amount shall be deposited, before shipping the order.

The order may be executed using PayPal. The users/customers should connect their PayPal account with Aisha Diri. The payment will be executed using the PayPal account, charging a credit card or a pre-paid card, and the payment terms are those of the credit/pre-paid card. The order is executed immediately, having successfully completed the payment procedure and the order that the users/customers have made is delivered.

15. Shipping Fees and Methods

Aisha Diri coordinates with ACS Courier for safe and fast delivery. The shipping fees burden the user/customer and are included in the order.

16. Date and Time of Delivery

The products will be delivered to the address that the user/customer has chosen in 2-3 working days for most areas in Greece, as long as there is stock availability. In the case of remote areas the time of delivery increases to 5 more days. In the case that the selected products are not promptly available, Aisha Diri is obligated to instantly notify the user/customer about the precise delivery day.

17. Delivery Delay

The order may be delayed, in the case that the e-mail or telephone communication with the user/customer is not possible (if a problem regarding the order, whether it is related to the product or its payment), due to incorrect personal data submission. The delivery may be also delayed in the event of extreme weather conditions, strikes or force majeure, which may affect the order transfer and delivery. In this case, Aisha Diri will communicate with the user/customer to inform and ask whether he/she wishes to receive the order without this certain product or suggest a replacement.

18. Product Condition Check

All users/customers are obligated to unwrap the delivery (without ruining the package) and check the products. Aisha Diri should be notified, in the event that the received products are not in good condition within ten (10) days. If the ten days timeline expires it is automatically assumed that the products have been received in good condition.

19. Product Return and Replacement – Charge on Aisha Diri

In the event of false delivery, such as delivery of a product other than the ordered one in kind or quantity or delivery in a ruined package, either partially or completely, or delivery of a faulty product, the user/customer may not accept the order in the first place, or ask for refund after contacting Aisha Diri. The products must be returned in the shape they were delivered to the user/customer. In the case that the products are not returned in the ten days timeline as stated above, Aisha Diri has the right not to accept the return and refuse the refund. Either way the product must be returned along with all documents that followed the delivery (eg retail sale receipt) and the full package. The way in which the product will be returned and replaced will be agreed orally or via e-mail between the user/customer and Aisha Diri. If the products are returned in bad condition Aisha Diri has the right to ask the user/customer for refund, depending on the damage. Furthermore, Aisha Diri has the right to proceed to unilateralism act of total or partial amount offset of this demand towards the user/customer. In any occasion of refunding the user/customer, the refund will be deposited in the user’s/customer’s bank account or in a voucher for future purchase from Aisha Diri.

20. Complaint Submission

In the occasion that the user/customer was not satisfied with the execution of the order or for any other reason regarding Aisha Diri, he/she has the right to fill in the complaint submission form which is available on the website, within ten (10) days since the problem occurred. Aisha Diri will study the complaint and respond via e-mail to the user/customer within ten (10) days, maintaining the right to ask for clarifications to settle the issue.

21. Newsletter mailing to the user/customer

The user/customer of the website may receive Aisha Diri newsletter via e-mail, by submitting his/her name and e-mail address.

22. Contacting Aisha Diri

The user/customer of the website may contact Aisha Diri via e-mail, using the relevant application that is adjusted to the “Contact Us” webpage, by filling in the special communicating form.

23. Cookies

Aisha Diri uses cookies, in order to provide to the users/visitors information and improved services (order tracking, personal settings, shopping carts or reminder lists in between visits etc), as well as executing the orders in the most efficient way.

24. Current Laws - Jurisdiction

The current contract is governed by the European and Greek Laws, especially the legislations that settle issues involving electronic trade, long distance sales, intellectual rights protection and consumers protection.

In the event that a conflict between the user/customer and Aisha Diri, regarding the present terms of use, surfaces, the first is obligated to contact Aisha Diri within ten (10) days, before launching any juristic proceedings. The delinquency in performing this term constitutes to violation of a contract clause, that has been made between the user/customer and Aisha Diri.

The Athens Court of First Instance is authorized to adjudicate any difference that may occur regarding either the use of Aisha Diri or the interpretation and compliance with or because of the present terms of use.

The website provides the official translation of the present terms of use in english. In the event of translation rendering, the greek version will be followed, which is the original text of the present terms of use and the operation rules.
